Terms of Service

These Terms of Service ("Terms") govern your use of the FishVerify mobile application ("Application," "App," "Service") created by SENAL YAZILIM DANISMANLIK TICARET VE ITHALAT IHRACAT LIMITED SIRKETI ("Service Provider," "we," "us," or "our"). FishVerify is a Freemium fish identification service.

By downloading, installing, or using FishVerify, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use the Application.

1. License to Use

We grant you a limited, non-exclusive, non-transferable, revocable license to use FishVerify for personal, non-commercial fish identification purposes, subject to these Terms.

You may not:

• Copy, modify, distribute, or create derivative works from the Application
• Reverse engineer, decompile, or disassemble any part of the Application
• Remove, alter, or obscure any copyright, trademark, or proprietary notices
• Use the Application for any illegal, unauthorized, or commercial purposes
• Transfer, sell, rent, lease, or sublicense the Application to third parties
• Use automated systems or bots to access the fish identification service

2. User Accounts and Your Content

Certain features may require you to create an account. You are responsible for:

• Maintaining the confidentiality of your account credentials
• All activities that occur under your account
• Notifying us immediately of any unauthorized access

Your Photos and Data: By uploading photos to FishVerify, you grant us full ownership and all rights to those photos. We may use, store, process, modify, and distribute your submitted photos for any purpose, including but not limited to providing fish identification services, improving our algorithms, training our AI models, marketing materials, and any other business purposes. Photos submitted through the app become our property.

3. Subscription and Payments

FishVerify is offered as a Freemium service with basic features available for free. Premium features require a paid subscription that automatically renews unless cancelled before the renewal date.

Payment Terms:

• Billing: Subscriptions are billed in advance on a monthly or annual basis
• Auto-Renewal: Subscriptions automatically renew at the end of each period unless cancelled at least 24 hours before renewal
• Refunds: All fees are generally non-refundable except as required by applicable law or our refund policy
• Price Changes: We reserve the right to modify subscription fees with advance notice to active subscribers
• Cancellation: Cancel anytime through your device's subscription management settings (App Store or Google Play)

4. Acceptable Use

To maintain a safe and reliable service for all users, you agree not to:

• Violate any applicable laws, regulations, or third-party rights
• Transmit viruses, malware, or any harmful code
• Interfere with, disrupt, or overload our servers or infrastructure
• Attempt unauthorized access to any part of the Application or our systems
• Submit inappropriate, offensive, or illegal content for identification
• Use the service for commercial purposes without authorization
• Impersonate others or misrepresent your affiliation with any person or entity
• Scrape, harvest, or collect data from the Application using automated means

5. Intellectual Property

FishVerify, including its design, features, algorithms, and content, is owned by us and protected by international copyright, trademark, and intellectual property laws. The FishVerify name, logo, and related marks are our trademarks and may not be used without prior written permission.

Fish Database: The fish species information, descriptions, and identification data in FishVerify are compiled from various sources and are provided for educational purposes. We strive for accuracy but cannot guarantee all information is complete or error-free.

6. Third-Party Services and Links

FishVerify may contain links to third-party websites, services, or resources. We do not control, endorse, or assume responsibility for any third-party content, privacy policies, or practices. Your use of third-party services is at your own risk.

7. Disclaimers and Accuracy

FishVerify is provided on an "AS IS" and "AS AVAILABLE" basis without warranties of any kind, either express or implied.

Important: We do not warrant that:

• Identification Accuracy: Fish identifications will be 100% accurate. Our AI-powered system provides suggestions based on visual analysis, but results may vary based on photo quality, angle, and other factors
• Service Availability: The app will be uninterrupted, secure, or error-free
• Data Completeness: All fish species or regional variations will be included in our database
• Error Correction: All bugs or issues will be corrected immediately

User Responsibility: You are responsible for verifying fish identifications, especially regarding regulations, safety (poisonous species), and catch limits. FishVerify is an educational tool and should not be your sole source for important decisions.

8. Limitation of Liability

To the maximum extent permitted by law, we shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to:

• Loss of profits, revenue, data, or business opportunities
• Incorrect fish identifications or reliance on identification results
• Service interruptions, delays, or inability to access the Application
• Unauthorized access, data breaches, or security incidents
• Bugs, viruses, or harmful code transmitted through the Application
• Third-party content, services, or links
• Any harm resulting from decisions made based on FishVerify identifications

Our total liability to you for all claims shall not exceed the amount you paid us in the 12 months preceding the claim, or $100, whichever is greater.

9. Indemnification

You agree to indemnify, defend, and hold us harmless (including our officers, directors, employees, and agents) from any claims, liabilities, damages, losses, and expenses, including reasonable legal fees, arising from:

• Your use or misuse of FishVerify
• Your violation of these Terms
• Your violation of any third-party rights
• Any content you submit to the Application
• Any reliance on fish identification results

10. Termination

We may suspend or terminate your access to FishVerify immediately, without prior notice, for any reason including:

• Violation of these Terms
• Fraudulent, abusive, or illegal activity
• Extended periods of inactivity
• Non-payment of subscription fees

Upon termination, your right to use FishVerify ends immediately. Sections that by their nature should survive termination will remain in effect, including disclaimers, limitations of liability, and indemnification.

11. Changes to These Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes by:

• Updating the "Effective Date" at the top of this page
• Providing in-app notifications for significant changes
• Sending email notifications to registered users when appropriate

Your continued use of FishVerify after changes take effect constitutes acceptance of the updated Terms. If you do not agree to the new Terms, you must stop using the Application.

12. Governing Law and Disputes

These Terms are governed by the laws of the jurisdiction where our Service Provider is established, without regard to conflict of law provisions. Any disputes arising from these Terms or your use of FishVerify shall be resolved through binding arbitration or in the courts of that jurisdiction.

13. General Provisions

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full effect. Our failure to enforce any right or provision does not constitute a waiver. These Terms constitute the entire agreement between you and us regarding FishVerify.
